The EU must take strong action to preserve what remains of interim pologne rule of law. Threats to the rule of law undermine the legal, political and economic basis of our Union. They also threaten the safety of European citizens and communities.
The Commission must urgently apply for interim measures to prevent the further deterioration of Poland’s rule of law. Otherwise, the current wave of attacks against judges will succeed in intimidating and removing those who most keenly and consistently enforce EU law and defend the principle of judicial independence.
MEDEL has therefore signed an open letter to the President of the Court of Justice, urging him to intervene in this matter and asking him to grant interim measures.

The European Court of Justice (CJEU) has ordered the suspension of the activities of Poland’s so-called “disciplinary chamber” for judges. It is the modern equivalent of a star chamber and, in effect, the stepping stone on which the arbitrary new disciplinary regime put in place by the Polish government has been constructed. The CJEU’s order is particularly significant because, at the beginning of it, the Court explicitly points out that the disciplinary chamber has not complied with the judgment in A.K. and the connected rulings by which it had previously been enjoined to obey both EU and Polish law (paragraphs 18-24).
